Joint Press Release: Boydstun and Cottrell Reach Settlement of All Pending Claims Boydstun Equipment Manufacturing, LLC and Cottrell, Inc. have reached a settlement resolving the claims pending between them in the United States District Court for the District of Oregon and the U.S. Patent and Trademark Office’s Patent Trial and Appeal Board. The settlement is a compromise of disputed claims, and the parties have not admitted any liability or the validity of any claim or defense in the litigation or patent office disputes. Under the terms of the settlement, Boydstun agrees not to enforce its patents and patents assigned to it against Cottrell or Cottrell’s customers, and Cottrell agrees not to enforce its patents and patents assigned to it against Boydstun or Boydstun’s customers with respect to Boydstun’s current strap tie-down products. As a result of the settlement, the lawsuit Boydstun Equipment Manufacturing, LLC v. Cottrell, Inc., No.3:16-cv-00790-SI (D. Oregon) will be dismissed with prejudice. Boydstun and Cottrell are pleased to have resolved this dispute and look forward to continuing their respective efforts to lawfully compete in the manufacture and sale of high-quality car haulers.
